Federal and Florida privacy compliance
Optimal Mortgage LLC is subject to privacy and information-safeguarding requirements under applicable federal and state law, including:
- Gramm-Leach-Bliley Act (GLBA) & FTC Safeguards Rule (16 CFR Part 314) — We maintain a written Information Security Program governing the collection, storage, and protection of nonpublic personal information (NPI). NPI includes any personally identifiable financial information you provide to us or that we obtain in connection with providing mortgage services. If you become a customer, you may receive a separate GLBA Privacy Notice describing our information sharing practices and your opt-out rights.
- Fair Credit Reporting Act (FCRA) / FACTA — When you apply for a mortgage, we obtain credit reports from consumer reporting agencies. We use credit information only as permitted by law. If a credit score is obtained, we provide a Notice to Home Loan Applicant disclosing your credit score, the bureau source, and adverse factor codes. You have rights under the FCRA regarding your credit file, including the right to dispute inaccurate information.
- CFPB Regulations — Our mortgage origination activities are subject to oversight by the Consumer Financial Protection Bureau (CFPB). We comply with all applicable CFPB regulations, including those governing mortgage disclosures (TRID), loan originator compensation, and consumer data rights.
- Florida Chapter 494 (Mortgage Brokerage) — We comply with all Florida state privacy and data protection requirements applicable to licensed mortgage brokers, including the Florida Office of Financial Regulation (OFR) examination standards.
Nonpublic personal information (NPI)
Under the Gramm-Leach-Bliley Act, "nonpublic personal information" (NPI) means personally identifiable financial information — and any list, description, or grouping of consumers derived from such information — that is not publicly available. Examples of NPI we collect include your income, assets, credit history, Social Security number, loan application information, and account balances. We protect NPI in accordance with our written Information Security Program and the FTC Safeguards Rule (16 CFR Part 314).
We do not sell NPI to third-party marketers. We share NPI only as necessary to complete your mortgage transaction, comply with legal requirements, or as otherwise permitted under the GLBA and applicable law.
